The Austin office of national labor and employment law firm Constangy Brooks & Smith, LLP is pleased to announce that it is expanding with the addition of partner Scott Agthe and associate Amy Ybarra. Both were most recently with the Agthe Law Firm, P.C. The pair will officially join Constangy when the Austin office relocates on February 13 to its new location at 8911 Capital of Texas Highway, Ste. 3350, Austin, TX 78759. The Austin office, opened in 2003, is headed by partner Mark Flora.

Agthe is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. He brings to the firm 24 years of employment law experience and a state-wide practice. He has handled hundreds of cases, alleging all forms of discrimination, harassment, retaliation, Fair Labor Standards Act violations and trade secret and non-compete violations. Agthe actively counsels clients on policies and preventive measures. He has a wealth of experience in affirmative action plans, workers’ compensation act-rejection work injury plans, WARN Act compliance and employee benefits law. He has also done a significant amount of traditional labor law including collective bargaining, unfair labor practice charges and other related issues.
Agthe is a Fellow of the Texas Bar Foundation, the highest honor available from the State Bar of Texas. He is AV® Preeminent™ Peer Review Rated By Martindale-Hubbell and was selected this year as one of Texas’ Top Rated Lawyers. He serves as secretary of the Austin Bar Association Labor & Employment Section and is a member of the Labor & Employment Law Section of the State Bar of Texas. Before starting his own law firm in 2007, Agthe was a partner and the head of the labor and employment practice group at Brown McCarroll, LLP, an Austin law firm.
A graduate of the University of Houston Law Center, Agthe received his Bachelor of Arts with High Honors from New Mexico State University.
Amy Ybarra has represented employers and management in all aspects of labor and employment counseling and litigation (including mediation and arbitration) such as employment discrimination and harassment (sex, race, national origin, disability, religion, etc.) claims, negligent hiring and supervision, breach of employment contracts and work-related immigration visas. Amy also provides counsel and advice to employers on federal and state laws, including issues concerning disability accommodation, family and medical leave, wage and hour, policies and procedures, records retention, employee discipline and workplace safety. She has represented employers in agency investigation and administrative hearings before the EEOC, DOL, OSHA, TWC and other agencies. She is licensed in Texas and New Mexico.
Ybarra graduated with honors from Northern Illinois University College of Law.
