Miller & Chevalier Chartered today announced that David H. Resnicoff has joined the firm as a Member. Resnicoff most recently served as Associate General Counsel and Vice President, Ethics and Compliance, at Baxter International, where he built and operated Baxter’s modern Global Compliance Program. Before that, he was part of the turnaround team at Tyco International, where he was Associate Compliance Counsel and Director and Counsel for Investigations. Prior to his in-house positions, he spent eight years prosecuting healthcare and other government fraud, as well as other federal crimes, as an Assistant United States Attorney for the Eastern District of Pennsylvania in Philadelphia. Philadelphia is one of the most active offices in the country with regard to healthcare fraud enforcement and has established a reputation for its sophisticated and creative approach to investigating and resolving these cases.
Resnicoff’s practice will focus on helping heavily regulated companies, and in particular healthcare companies, meet their U.S. and international compliance obligations, drawing upon his deep experience in the areas of compliance counseling, risk assessment, global investigations, and government enforcement issues. In the course of his career, Resnicoff has built and operated sophisticated global compliance programs; supervised and performed hundreds of complex investigations; successfully defended corporate clients accused of a wide variety of violations of federal law; and successfully prosecuted healthcare, government and other fraud, as well as other federal crimes. He has deep experience in a wide variety of regulatory regimes, including all aspects of U.S. healthcare fraud and abuse, misbranding, international anti-corruption (FCPA and U.K. Bribery Act), and export controls and sanctions.

While at Baxter International Inc. from 2006-2011, Resnicoff oversaw the company’s global compliance program and led a team of 18 lawyers and compliance professionals. His responsibilities included compliance education, policy development, monitoring, internal and government investigations, and M&A compliance due diligence. When he was at Tyco International from 2003-2006, he helped build the company’s new ethics and compliance program and managed the company’s internal compliance investigations, as well as its response to government investigations. Prior to that, he spent eight years as an Assistant United States Attorney for the Eastern District of Pennsylvania. In recognition of his excellent performance, Resnicoff received the U.S. Department of Justice Director’s Award for Superior Performance, Prosecution of Health Care Fraud. From 1990-1995, he practiced in Covington & Burling’s Washington office, where he litigated federal matters and performed internal investigations.

Resnicoff earned a B.A. cum laude from Colby College; an M.A., with distinction, in International Affairs from John Hopkins School of Advanced International Studies; and a J.D. cum laude from Boston College Law School.
