Chadbourne Represents Developers in approximately $353 Million Financing of the Free State Windpower Project in Kansas

Chadbourne & Parke represented a 50-50 joint venture between Duke Energy Renewables (a unit of Duke Energy) and Sumitomo Corp. of America (the U.S. subsidiary of Sumitomo Corp.) as the developers in connection with approximately $353 million in financing for two wind farms in Kansas.

The financing, which closed April 18, consists of a construction and term loan facility of approximately $330 million and a letter of credit facility totaling roughly $23 million. The lenders involved in the deal were Sumitomo Mitsui Banking Corporation, Mizuho Corporate Bank, Ltd., and Bank of Tokyo-Mitsubishi UFJ, Ltd.
Working for Chadbourne on the deal were partners Chaim Wachsberger and Eli Katz, counsel Donna Bobbish and associates Matthew Gurch and Rebecca Abou-Chedid.
The financing package was for the development, construction and operation of the 131-megawatt (MW) Cimarron II Windpower Project in Gray County and the 168-MW Ironwood Windpower Project in Ford County.
