Antitrust Litigator Joins Commercial Litigation Department at Cozen O’Connor

Cozen O’Connor announced today that antitrust litigator David H. Reichenberg — who has successfully represented some of the country’s best-known technology brands, including Google, Netflix, Twitter, and YouTube — has joined its nationally recognized Commercial Litigation Department. Reichenberg, who comes to the firm from Wilson Sonsini Goodrich & Rosati, joins as a member and will work out of Cozen O’Connor’s midtown New York City office.

As a litigator, Reichenberg advises and defends clients in bet-the-company cases involving unfair competition allegations, often matters that involve the complex intersection of antitrust and intellectual property (IP) law. He also advises Fortune 500 clients on the antitrust implications of potential business initiatives — including corporate mergers and acquisitions — and represents them, when necessary, before the Federal Trade Commission and Department of Justice.

In 2014 Reichenberg successfully represented Google in Martin v. Google — a headline-generating case in which a California court found that despite the opposition’s claims that it monopolizes the search engine business, Google’s search results are protected free speech under the First Amendment (the decision was upheld on appeal). Reichenberg has also successfully defended Netflix in a class action lawsuit in the Northern District of California and Universal Surveillance in a monopolization case.

Prior to joining Wilson Sonsini Goodrich & Rosati in 2009, Reichenberg was an associate at Axinn Veltrop & Harkrider LLP, where his practice focused on merger clearance and other complex litigation, including trademarks and antitrust.

Named to New York Super Lawyers’ “Rising Stars” listing from 2015 through 2017, Reichenberg also maintains an active pro bono practice. Most recently he was first-chair on a trial team that secured a favorable jury verdict in the Eastern District of New York on a 1983 civil rights claim under the Fourth Amendment.

Reichenberg earned his J.D. at Fordham University School of Law and his B.S. in policy analysis and management at Cornell University.
