Prominent Retail Real Estate Duo Joins Fox in New York

Bolstering the firm’s presence in the New York market, Fox Rothschild LLP is pleased to welcome Scott R. Kipnis and Nicholas B. Malito as partners in the firm’s Real Estate Department. They were previously partners at Philadelphia-based firm Schnader Harrison Segal & Lewis LLP.

Kipnis has nearly three decades of experience guiding retail property development deals for national and regional chains. He serves a range of institutional and private sector clients ― as sellers, purchasers and developers ― in all phases of real estate transactions and negotiations and provides strategic insight on zoning, land use, title, insurance coverage and financing issues. Kipnis has a particularly keen understanding of the retail property development life cycle, from construction to store launch and beyond, and has advised institutional Fortune 150 and big box retailers. His practice also covers all aspects of commercial leasing, including construction-related disputes, permits, variances and diverse development issues. Additionally, he supervises principally based real estate, construction, retail litigation and bankruptcy matters. He earned his J.D. from Hofstra University, with distinction, and his B.S. from University of Maryland.

Malito has a robust transactional and litigation practice that assists a range of national and regional clients in commercial leasing and retail property development, from the inception of lease negotiations to retail store launch. His practice draws on a broad background of civil litigation experience that helps clients manage an array of issues, including prosecuting and defending appeals, business torts, intellectual property disputes, claims for breach of contract, real estate disputes, bankruptcy avoidance actions and claims for employment discrimination. He earned his LL.M. and J.D. from St. John’s University School of Law and his B.A. from Fordham University.
