Nixon Peabody is expanding its Commercial and IP Litigation practice in Rochester with the return of partner Richard A. McGuirk. Rick was previously an attorney in Nixon Peabody’s Litigation practice from 1999 through 2010, and was elevated to partner in 2002.
Rick represents companies and individuals in complex litigation in a variety of high-stakes areas. These areas include: complex commercial litigation, securities and derivative cases; IP litigation; and litigation arising from M&A transactions.

He’s an excellent litigator and well respected by his clients and peers,” said Carolyn Nussbaum, managing partner of Nixon Peabody’s Rochester office. “He will add greater depth to our Commercial and IP Litigation teams on the ground in Rochester and throughout the firm, and will serve as a terrific mentor to our up and coming associates.”
With extensive experience in securities and intellectual property matters, Rick’s portfolio of securities clients includes issuers, broker-dealers and officers and directors. He has defended these clients in matters arising from the Securities Act, Securities Exchange Act and Sarbanes-Oxley violations. Rick has also been involved in intellectual property disputes—from patent, trademark and copyright infringement, litigation before the Patent Trial and Appeal Board under the America Invents Act, to trade secret and licensing disputes—with an emphasis on sectors such as pharmaceuticals, chemicals and mechanical inventions.
Joining Nixon Peabody from LeClairRyan, Rick earned his JD, cum laude, from Brooklyn Law School and a BA in political science from Binghamton University.
