The global law firm Jones Day has announced that Daniel (Dan) Cody has joined the Firm’s Health Care Practice as a partner in the San Francisco Office.
Mr. Cody’s practice encompasses advising health care industry clients, including hospitals and health systems, post-acute care providers, digital health companies, and other health care providers and suppliers, on a wide variety of health law regulatory, compliance, and fraud and abuse issues. Mr. Cody regularly advises health care industry clients on a wide array of complex regulatory compliance issues and investigations involving Medicare and Medicaid reimbursement and coverage, the federal False Claims Act, federal and state anti-kickback statutes, federal and state referral prohibitions, and state corporate practice of medicine provisions.
“Dan is a recognized leader in health care fraud and abuse and regulatory matters,” said Stephen G. Sozio, co-leader of Jones Day’s Health Care Practice. “As compliance, administrative, and reimbursement matters continue to become more complex, our clients will need the advice and practical counsel a lawyer with Dan’s experience can provide. He is a very good match for us and we are pleased that he is joining Jones Day.”
Mr. Cody has represented clients in regulatory and fraud and abuse matters in federal court and before federal and state entities such as the Department of Justice, Centers for Medicare & Medicaid Services, Office of Inspector General, and state administrative agencies. Mr. Cody also assists health care and life sciences companies with licensing, accreditation, and privacy matters.
“Dan arrives at Jones Day at a very critical time,” said James R. Dutro, who also co-leads the Health Care Practice. “The health care regulatory climate has never been more complicated and difficult to navigate, and the fact that Dan has represented and advised clients at both the state and federal levels makes him a very strong addition to what is already a formidable practice group.”
Mr. Cody’s recent representations include successfully negotiating a favorable settlement of a national False Claims Act investigation on behalf of a hospital system, utilizing a creative administrative appeal/litigation strategy to achieve an almost complete reversal of a $1.5 million Medicare contractor post-payment review overpayment determination, and assisting a digital health company in structuring its operations consistent with state pharmacy law.
“Because of the continuous changes in the health care industry, attorneys like Dan, who bring broad, in-depth experience to every client situation, become immediate assets to the practice and the office,” said Aaron Agenbroad, Partner-in-Charge of Jones Day’s San Francisco Office. “In particular, his familiarity with reimbursement matters and the success he’s had in that area will be of benefit to Jones Day clients in San Francisco and throughout the Firm.”
Mr. Cody is a member of the ABA (Health Law Section), American Health Lawyers Association, and California Society for Healthcare Attorneys and board member of the National Health Law Program and Larkin Street Youth Services. He has spoken and written extensively on all facets of Medicare and Medicaid programs.
