The Wilmington office of global law firm K&L Gates LLP has added Steven L. Caponi as a partner in the commercial disputes, cyber law and cybersecurity, and intellectual property litigation practices. Caponi joins K&L Gates from Blank Rome LLP, where he was chair of the cybersecurity & data privacy practice as well as administrative partner of the Wilmington office.
Caponi focuses his litigation practice on a broad range of corporate and intellectual property matters, including breach of fiduciary duty and corporate governance claims; M&A and securities litigation; patent infringement and intellectual property; and cybersecurity and data privacy issues, among others. He frequently appears before Delaware state and federal courts, including the Delaware Court of Chancery, in addition to handling matters in jurisdictions across the United States. Caponi also is recognized for his practical leadership on a wide range of cybersecurity policy and data privacy issues, including emerging trends, M&A due diligence, compliance with fiduciary duties, industry best practices, data breach preparedness and response, and federal and state regulation.
Caponi’s representative matters have included obtaining a successful defense verdict for the world’s largest social networking site in a patent infringement action filed in Delaware; serving as lead coordination counsel in a multi-district litigation on behalf of a syndicate of banks and Wall Street financial holding companies in connection with a complex commercial fraud in excess of $500 million; defending a prominent designer and manufacturer of women’s apparel in several shareholder derivative actions challenging the $120 million acquisition of a competitor; defending a leading energy provider against claims related to the sale of coal and hydroelectric assets worth in excess of $1 billion; and acting as national litigation counsel and defense group coordination counsel for a leading publisher of video games in a series of litigations before the Securities and Exchange Commission and the National Association of Securities Dealers as well as several state and federal courts.
